These Terms of Use ("Terms") govern your access to and use of the ON Real Estate website, area pages, and related services (the "Site"), operated by ONHOLDINGS.CA INC. ("ON," "we," "us," or "our"). By browsing the Site, submitting an enquiry through a listing, or purchasing an advertising placement, you agree to these Terms. If you do not agree, do not use the Site.
If you are a real estate agent who purchases an advertising placement, your use of the Site is also governed by the Advertiser Placement Agreement you sign with ON and by the ON Real Estate Refund Policy. Where these Terms and the Advertiser Placement Agreement conflict on a matter specific to a placement, the Advertiser Placement Agreement governs.
ON Real Estate is a directory and digital-advertising surface. It sells non-exclusive advertising placements — carousel slots on area pages — to individual advertisers (licensed real estate agents) across Ontario. Each area page carries up to three rotating slots; placements are non-exclusive and filled by open selection. Through the Site, prospective home buyers and sellers ("visitors") can find an advertiser and contact them by submitting an enquiry. When you submit an enquiry through an advertiser's listing, ON passes it to that advertiser (and their brokerage) so they can respond to you directly.
ON Real Estate is an advertising platform. It is not a brokerage, and it does not itself trade in real estate, represent buyers or sellers, provide real estate advice, or take any share of any real estate transaction.
You must be at least 18 years old to submit an enquiry or purchase an advertising placement through the Site. To purchase a placement, you must be a licensed real estate professional in good standing with the Real Estate Council of Ontario (RECO) under the Trust in Real Estate Services Act (TRESA), and your listing must self-identify your own RECO-registered brokerage. There is no eligibility or approval gate: once you purchase a placement and supply your listing details, your listing is built and goes live.
Use of the Site, submission of an enquiry, or payment of an advertising placement fee does not guarantee leads, enquiries, rankings, closed transactions, or income. ON operates an advertising directory and does not guarantee lead volume, search-engine ranking, the outcome of any real estate transaction, or any specific income or business result, for either advertisers or the visitors who use the Site.
When you submit a contact or enquiry form through an advertiser's listing, you are asking to be connected with that advertiser. By submitting the form, you consent to ON collecting and using your information as described in our ON Real Estate Privacy Policy, and to being contacted by the advertiser (and, where relevant, ON) using the contact information you provide, for the purpose of responding to your enquiry.
ON passes your enquiry to the advertiser (and their brokerage) whose listing you used. Once passed, your relationship with that advertiser and their brokerage is between you and them — ON is not a party to, and has no liability for, any transaction, representation, or advice arising from that relationship. Any referral of a client between brokerages is a separate matter handled brokerage-to-brokerage; ON takes no consideration from any transaction.
Real estate agents purchase advertising placements as described in the Advertiser Placement Agreement and the ON Real Estate Refund Policy, both of which form part of these Terms for advertisers. A placement is a non-exclusive carousel slot for a flat advertising fee; it is not an exclusive territory, a licence, or a franchise, and it grants no right to operate a business under the ON marks. Nothing in these Terms overrides a specific term of the Advertiser Placement Agreement applicable to a signed advertiser.

All ON Real Estate branding, domain names, website infrastructure, area page templates, and directory data are and remain the sole property of ONHOLDINGS.CA INC. Nothing in these Terms grants you any ownership interest in ON's intellectual property.
Advertisers retain ownership of the professional content, photos, and materials they supply for their listing, and grant ON permission to display, host, and index that content on the Site for the term of their advertising placement, as further described in the Advertiser Placement Agreement.
Listings display content supplied by advertisers, and may reference brokerages or featured local businesses. The advertiser is responsible for the accuracy and legality of the content it supplies, including compliance with the Competition Act and RECO advertising rules. ON operates a neutral advertising surface and does not independently verify advertiser-supplied content or endorse it. ON may remove content that is unlawful or inaccurate, but assumes no responsibility for advertiser-supplied or third-party content. If you believe content on the Site is inaccurate or misleading, contact us using the details in Section 15.
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. ON does not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, ON's total liability to you arising out of or related to your use of the Site will not exceed the amount you paid to ON in the twelve (12) months preceding the claim, or CAD $100 if you have not paid ON anything. Neither party is liable for indirect, consequential, punitive, or speculative losses, including lost profits, lost transactions, or loss of business opportunity.
You agree to indemnify and hold ON harmless from any claim, loss, or damage arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
ON may update these Terms from time to time. Material changes will be posted on the Site with an updated effective date. Continued use of the Site after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising from these Terms will first be addressed through good-faith negotiation; if unresolved, the parties will follow the dispute-resolution process set out in the Advertiser Placement Agreement (for advertisers) or may be resolved through the courts of Ontario (for all other users).
