This policy is written to be consistent with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

1. Scope of This Policy

This Privacy Policy explains how ONHOLDINGS.CA INC. ("ON," "we," "us," or "our") collects, uses, discloses, and protects personal information through the ON Real Estate website and related services (the "Site"). It applies to three groups of people: visitors browsing the Site; people who contact an advertiser by submitting an enquiry through a listing on an area page; and advertisers (real estate agents) who purchase a carousel placement and supply their listing details.

This policy should be read together with the ON Real Estate Terms of Use, the Advertiser Placement Agreement, and the ON Real Estate Refund Policy.

2. What Personal Information We Collect

From visitors: standard technical information such as IP address, browser type, device type, and pages viewed, collected automatically through cookies and analytics tools.

From people who submit an enquiry: name, email address, phone number, the area or listing you're interested in, and any details you provide about your buying or selling situation.

From advertisers: legal name, your own brand or trade name, contact details, your RECO registration number and your own RECO-registered brokerage name (self-identification), the area page(s) your placement appears on, the listing content you supply (display name, description or bio, service areas, links), any testimonials, awards, or other content you choose to feature, headshot and marketing photos, billing and payment information, and any other information you submit through the Listing-Specification Intake Form.

3. How We Collect Personal Information

We collect personal information directly from you when you submit a form on the Site (an enquiry or the Listing-Specification Intake Form), when you make a payment, and automatically through cookies and similar technologies as described in Section 8.

4. Why We Collect and Use Personal Information

We collect and use personal information to: pass your enquiry to the advertiser (and their brokerage) whose listing you contacted, so they can respond to you directly; build and maintain an advertiser's listing from the details the advertiser supplies; process placement and setup payments and issue receipts and refunds; communicate with advertisers and enquirers about their listing, account, or enquiry; meet our contractual obligations under the Advertiser Placement Agreement; and, where you have consented, send marketing or promotional communications.

We do not sell personal information to third parties.

5. Consent

By submitting a form on the Site, you consent to the collection, use, and disclosure of your personal information as described in this policy, for the purposes described above. Where we rely on your consent to send marketing communications under CASL, that consent is separate from — and not required for — us responding to your enquiry or building your listing.

You may withdraw consent to marketing communications at any time, using the unsubscribe mechanism in the communication or by contacting us using the details in Section 11. Withdrawing consent will not affect the handling of an active enquiry or advertising placement, which relies on a different basis for collection as described in Section 4.

6. Disclosure of Personal Information

To the advertiser you contact: when you submit an enquiry through a listing, we pass your contact information and enquiry details to that advertiser (and their brokerage) so they can follow up with you directly. Where an area page shows more than one advertiser, your enquiry goes to the advertiser whose listing you used.

Within ON Group of Companies: personal information may be shared with other entities within ON Group of Companies for internal administration, reporting, and — where permitted — marketing purposes.

Service providers: we may share personal information with third-party service providers who help us operate the Site (such as payment processors, hosting providers, and email service providers), under agreements that require them to protect your information and use it only for the purpose we've engaged them for.

Legal disclosure: we may disclose personal information if required by law, regulation, court order, or to protect the rights, property, or safety of ON, our advertisers, or the public.

7. Advertisers' Responsibility for Personal Information

Once your enquiry is passed to an advertiser, that advertiser and their brokerage become responsible, under applicable law and their own professional obligations, for how they handle your personal information going forward. This Privacy Policy governs ON's collection and handling of personal information — it does not govern how an advertiser or brokerage independently uses information after an enquiry is passed to them.

Advertisers who supply content for their listing (for example, testimonials that name other people) are responsible for having obtained any consent required to publish that content. Please do not include personal information about anyone else unless they have consented to appear.

8. Cookies and Analytics

The Site uses cookies and similar technologies to operate core features, remember preferences, and understand how visitors use the Site through analytics tools. You can control cookies through your browser settings; disabling cookies may affect some Site functionality.

9. Data Retention

We retain personal information for as long as necessary to fulfil the purposes described in this policy, including any applicable legal, accounting, or reporting requirements. Enquiry information is retained for a limited period after it is passed to an advertiser; advertiser placement and listing information is retained for the duration of the advertising placement and for a period afterward as required for legal and business record-keeping purposes.

Benchmarked to Ontario/Canadian standard practice: enquiry data is retained for no longer than 24 months from last contact, or for the duration of any resulting representation relationship if longer, then deleted or anonymized — consistent with PIPEDA Principle 5 (limiting retention to what's necessary for the identified purpose). Advertiser placement and listing data is retained for the duration of the advertising placement plus 6 years, matching the record-keeping period Ontario real estate brokerages follow under TRESA (O. Reg. 579/05, s. 19) — ON isn't itself a brokerage, but this keeps ON's practice consistent with the standard the rest of the industry it operates alongside is held to.

10. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

All personal information collected through the Site is hosted and stored within Canada.

11. Your Rights and How to Reach Us

Under PIPEDA, you have the right to access the personal information we hold about you, request correction of inaccurate information, and withdraw consent (subject to legal or contractual restrictions, and the limits described in Section 5). To exercise these rights, or for any question about this policy, contact our Privacy Officer at privacy@onrealestate.ca.

If you have a concern about how we've handled your personal information that we haven't resolved to your satisfaction, you may contact the Office of the Privacy Commissioner of Canada.

12. Children's Privacy

The Site is not directed at individuals under 18. We do not knowingly collect personal information from anyone under 18. Consistent with the Terms of Use, you must be at least 18 to submit an enquiry or purchase an advertising placement.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted on the Site with an updated effective date. Continued use of the Site after a change takes effect constitutes acceptance of the updated policy.
